To solve problems, AI breaks them down into numerous pieces of information and processes them step by step to achieve meaningful outcomes. AI finds applications in various areas, including expert systems, natural language processing, speech recognition, and machine vision. The challenge lies in understanding the calculations and strategies employed by AI to make decisions, leading to the ‘black box paradox’ or ‘explainability issue,’ especially concerning legal liability.[1]
The growing prominence of AI systems and their expanding autonomy in decision-making across different industries presents significant legal challenges. As AI becomes more sophisticated, it raises concerns about potential consequences when accidents or harm occur due to AI-driven decisions. The issue lies in determining responsibility and liability for such incidents, as the complexity of AI algorithms makes it challenging for humans to comprehend the exact reasoning behind the decisions made by these systems. This lack of transparency leads to the ‘black box paradox,’ making it difficult to attribute accountability and address legal ramifications adequately. As AI continues to evolve, finding appropriate legal frameworks to deal with AI-related incidents becomes a crucial concern for society and policymakers.
Black Box Paradox
The “black box problem” refers to the inability to understand how deep learning systems arrive at their decisions or conclusions. This term is used to describe the lack of transparency in the decision-making process of these AI systems, where the reasoning behind their actions remains obscured and difficult to interpret.[2]
The legal system faces a significant challenge with companies using AI-powered models that prioritize accuracy over interpretability. These black-box models are created through algorithms directly from data, making it impossible for even the code developer to understand how the variables lead to the predicted output. Unlike the human mind, AI neural networks operate differently, and even listing all variables wouldn’t help dissect the algorithm’s complex functions.
This paradox poses difficulties under English law, where claimants seeking remedies must demonstrate both factual and legal causation. Criminal cases require determining the actus reus and mens rea, but understanding the AI’s internal data processing makes ascertaining the mental element impossible.
Although human minds have exhibited black-box functions, courts have historically held individuals accountable based on fault-based liability. However, sanctions can only be applied to legal entities. Thus, navigating AI-related legal liabilities remains a complex and challenging task for the legal system.[3]
For instance, consider a scenario where an autonomous vehicle hits a pedestrian instead of applying the brakes as expected. Due to the black box nature of the AI system, we cannot trace the exact thought process that led to this decision. If such an accident occurs and it is found that the perception system failed to detect the pedestrian, experts would assume that the system encountered a novel or unfamiliar element in that particular situation. To improve its performance in the future, the system would then be analyzed to identify what caused the oversight, and it would be exposed to more similar situations for learning and enhancement.
Liability in case of Autonomous vehicles
Autonomous Vehicles, also known as self-driven cars, rely on AI technology to control their operations. These vehicles utilize a combination of sensors, actuators, complex algorithms, machine learning systems, and powerful processors to execute their software. Various sensors located throughout the car help the vehicle sense its environment. Radar sensors monitor nearby vehicles’ position and distance, cameras detect traffic lights, road signs, and track other vehicles and pedestrians, while LIDAR sensors use light pulses to measure distances, identify road edges, and detect lane markings. Currently, the main concern is not whether India is ready to accommodate autonomous vehicles technologically, but rather if Indian laws are equipped to handle the challenges arising from them, particularly the issue of liability for accidents.
In the UK, the development of regulations for autonomous vehicles has been more progressive. The Automated and Electric Vehicles Act, 2018, specifically states that the owner of the autonomous vehicle will be held liable for accidents caused by the vehicle. However, there are discussions on shifting liability to the manufacturer in future plans.
In the US, regulations on autonomous vehicles vary between states. Some states place liability on the manufacturer when the vehicle is in autonomous mode. The fatal Uber accident in Arizona [4]showed that human error played a significant role, and the driver was held liable.
In India, there is currently no specific legislation to regulate autonomous vehicles. Accidents involving motor vehicles are governed by the Indian Penal Code and the Motor Vehicle Act, which follows a “No Fault” liability principle. However, applying this principle to accidents involving self-driven cars raises questions about the manufacturer’s responsibility. Proposed amendments to the Motor Vehicle Act, 2016, are pending, seeking to exempt certain vehicles to encourage research and innovation. Under the Indian Penal Code, various laws address rash driving, causing death by negligence, causing hurt, and causing grievous hurt. However, the current statutes do not encompass self-driven cars. The Supreme Court has differentiated between the Indian Penal Code and the Motor Vehicle Act, stating that they serve different purposes. While both can hold individuals liable, they do not explicitly cover self-driven cars.[5]
Example of AI bias
AI bias is a prevalent issue that can be observed in various real-life scenarios. One example is the racism in the American healthcare system, where AI systems trained on non-representative data perform poorly for underrepresented populations, leading to biased predictions favoring white patients over black patients.
Another instance of bias is depicted in Google’s search results, where searches for “CEO” predominantly display male CEOs despite the relatively low representation of women in top executive positions. Amazon’s hiring algorithm also exhibited bias towards male applicants, penalizing resumes that indicated female gender or attendance at all-female institutions. While adjustments were made to address this bias, it highlights the potential for AI to perpetuate existing prejudices. In India, the absence of specific legislation for autonomous vehicles raises questions about liability and compensation in accidents involving self-driven cars.
AI bias reflects society’s biases and is influenced by the underlying data used to train the models. Addressing this bias requires testing algorithms in real-life settings, accounting for counterfactual fairness, implementing Human-in-the-Loop systems, and reforming science and technology education to address these issues globally and locally. One significant example is the General Data Protection Regulation (GDPR) in the European Union. The GDPR contains specific provisions pertaining to AI, mandating organizations to be transparent about their use of personal data and obtain explicit consent for specific data uses.
The IEEE’s Ethically Aligned Design (EAD) guidelines are another notable initiative, providing a comprehensive framework for designing AI systems aligned with human values. These guidelines cover a wide array of aspects, including privacy, transparency, and accountability.
Furthermore, industry-specific regulations exist, like the National Institute of Standards and Technology (NIST) guidelines for responsible AI use in the financial sector and the Federal Aviation Administration (FAA) guidelines for ethical and safe operation of drones.
